What does a trust company (trustee) do in Malaysia?

A trust company holds and administers assets on behalf of others under a trust deed or a will. In practice that ranges from retail estate planning (holding a private family trust, executing a will, keeping custody of a wasiat) to corporate work (acting as bond or sukuk trustee for an issuance, or as the trustee of a unit trust fund). Trustees are licensed corporations, not the same as a lawyer or a will-writer.

How are trustees regulated in Malaysia?

Onshore trust companies are incorporated and regulated under the Trust Companies Act 1949 and the Companies Act. Those acting as bond or fund trustees are also registered with the Securities Commission. Offshore trust companies operate out of Labuan under the Labuan Financial Services Authority and the Labuan Trusts Act 1996. AmanahRaya has its own statutory footing as the successor to the public trustee.

Which trustee is best for estate planning?

It depends on your situation. Is my money safe with a trust company?

Trust assets are held separately from the trustee company's own balance sheet, and licensed trustees are supervised. Risk comes mainly from fees, service quality and how well the trust is drafted, rather than the trustee going under.
